Derivative Works Terms

Derivative Works Policy

We are incredibly grateful for the creativity of this community. To ensure that everyone can create fan content safely and respectfully, we have established the following terms for "Derivative Works" (any content created by fans that uses any original Club Toebeans character design, name, voice, or world-building).

1. General Principles

   • 1. • Non-Commercial Use Only: You may create and share derivative works for personal, hobbyist purposes. You may not use the Club Toebeans (or it's talent) IPs' for any commercial gain (selling merchandise, charging for access to fan games, etc.) without a separate written agreement.

        • No Official Representation: Please do not present your work in a way that suggests it is an "official" release or endorsed by Club Toebeans.

        • Respect the Brand: Avoid creating content that is intentionally harmful to Club Toebeans reputation, contains hate speech, or promotes illegal activities.

2. Video & Clipping Guidelines

We love seeing our streams clipped and shared! To keep things fair:

• Wait Period: Please wait at least 24 hours after a stream ends before uploading clips to allow for the original VOD to be viewed.

• No "Re-uploads": Simply downloading a full stream and re-uploading it to your channel is not a derivative work and will be subject to a copyright claim. Please add your own editing, subtitles, or unique commentary.

• Monetization: You may monetize clips via platform programs (like YouTube Partner Program) as long as the content complies with the "Add Value" rule above.

3. Fan Games & Software

• Non-Profit: Fan games must be distributed for free. You may not charge for the game, donate for early access using streams such as Patreon, or include microtransactions using my IP.

• Attribution: Any fan game must include a clear disclaimer on the title screen: "This is a fan-made project and is not affiliated with Club Toebeans."

4. Prohibited Acts

You are strictly prohibited from using our characters or assets for:

• Political or Religious Promotion: Using our image to advocate for specific candidates, parties, or religious organizations.

• Machine Learning/AI: Using our voices, art, or model files to train AI models or generate "deepfake" content without explicit permission.

• Slander: Using the character or fake profiles to spread false information or harass others.

5. Rights & Ownership

By creating derivative works based on our IP, you acknowledge that we retain all rights to the original character design and branding.

Club Toebeans reserve the right to request the removal of any content that we believe violates these guidelines or harms the integrity of the brand.
